Proposals aim to limit rising asbestos claims
May 28, 2003
The Cleveland Plain Dealer describes the current effort to ban asbestos litigation and force all claimants to recover from a limited "trust fund." A mesothelioma victim would have to meet strict requirements for exposure, and then would receive a fixed sum of $750,000, even though jury awards for mesothelioma victims average $6.5 million. Although the trust fund is meant to address the asbestos problem over the next 30 years, as currently proposed not one dime goes to the medical research necessary to prevent the suffering in the first place.
